Thank you for choosing a BF&M home policy to protect your home.

Please read the policy and the schedule carefully and inform us if they do not meet your requirements.

Our aim is to provide you with the quality service you expect, in terms of the cover provided and especially in dealing with any claims that you make. If you are dissatisfied in any way with the service which we provide, please let us know and we will do all we can to help remedy the situation.

We welcome suggestions from customers which could help us to improve our service.

General Provisions
  1. This policy is evidence of the contract between you and us.
  2. The policy, the schedule and any endorsements are to be read as one document.
  3. Under those sections which are shown in the schedule as being covered, we will provide the insurance as described in the policy. This will be during any period of insurance for which you have paid or have agreed to pay the premium.
  4. The insured will comply with all conditions stated in the policy or the schedule.
  5. All dollar amounts expressed in the policy, the schedule and any endorsements refer to Bermuda dollars unless otherwise specified

Important Messages : The Policy
This policy has been prepared on the basis of information that you have provided. You must inform us of subsequent changes to this information as soon as possible (see General Condition 2)

A standard Home policy would include cover for:  

  • The buildings
  • The personal possessions inside (furniture, appliances, etc.)
  • All risks insurance on jewellery, cameras, laptops, etc.
  • Your liability to others as owner, occupier or tenant of the property

Examples of typical losses include:

  • A fire
  • Windstorm/hurricane damage
  • Burst pipe and flood damage
  • Wavewash damage during a storm
  • Lost item of jewellery
  • Theft of personal possessions
  • A visitor to your home suing you for damage to their person or property
  • A third party suing you when your dog bites them

These are only a few examples of losses or types of claims. Please view the policy for a complete description of the policy cover.

 

Definitions

The following words shall have the same meaning wherever they may appear in the policy, the schedule or any endorsements.

You
The person or persons named in the schedule as the policyholder.

Insured
You and any family members normally residing with you.

We/Us
BF&M General Insurance Company Limited.

Endorsement
Any alteration to the policy agreed by us in writing.

Excess
The first part of a claim which you have to bear.

Home
The private dwelling, house or private apartment at the location(s) described in the schedule and its domestic outbuildings.

Buildings
The buildings of the private dwelling, house or private apartment at the location(s) described including Landlord’s fixtures and fittings, cesspits or septic tanks, domestic outbuildings, swimming pools, tennis courts, patios, terraces, drives, footpaths, walls, gates and fences, but excluding docks, piers, jetties, external television and radio receiving equipment.

Windstorm
Shall mean windstorm, hurricane, cyclone or tornado (including rain accompanying any of these).

Fees and Associated Costs
Architects’, Surveyors’ and Legal Fees necessarily incurred in repair or replacement but excluding fees incurred in preparing or furthering any claim under this policy

  1. the cost of removing debris, demolition, shoring-up or propping, necessarily incurred in repair or replacement.
     
  2. the cost of complying with Local Authority and other statutory requirements unless notice of the need to comply was served upon you before the damage occurred or if they relate to undamaged parts of the buildings.

Contents
Furniture, household goods and personal effects, including money up to a limit of $250, belonging to or the responsibility of the insured or any domestic employees residing with you.

Personal Effects
Articles of clothing, toiletries and items of a personal nature normally worn or carried, including handbags, briefcases, suitcases and knapsacks, but excluding Valuable Property, Money and Credit Cards.

Valuable Property
Valuable Property is defined as articles of precious metal, works of art, jewellery and furs, that are kept inside your home. The policy provides cover for those items however there is a single article limit that applies. The policy does not cover any one item if the value exceeds 5% of the total sum insured on the contents of the home, UNLESS that item is separately specified and any amount exceeding one-third of the total sum insured on the contents in respect of all Valuable Property. We suggest that you list all items of valuable property to ensure complete cover.

Money
Cash, bank or currency notes, cheques or travellers cheques, stamps not forming part of a stamp collection, postal or money orders.

Credit Cards
Credit, debit, charge, cheque, bankers or Automatic Teller Machine cards issued to the insured.

Permanent Total Disablement
Disablement which permanently, completely and continuously prevents the injured person from attending to his usual occupation.

Loss of Limb
Permanent loss of use or loss by physical separation of a hand at or above the wrist or of a foot at or above the ankle.

Loss of Sight
Total loss of sight in one or both eyes which is beyond hope of improvement.

The words defined above appear in bold type wherever they are used in the policy. Where these words are used, please refer to the above definitions for their precise meaning.

 
Section A: Buildings

Definition
The buildings of the private dwelling, house or private apartment at the location, including Landlord's fixtures and fittings, cesspits or septic tanks, domestic outbuildings, swimming pools, tennis courts, patios, terraces, drives, footpaths, walls, gates and fences, but excluding docks, piers, jetties, external television and radio equipment.

Damage to the Buildings

Cover
The buildings are insured against damage by the following causes:

Fire, lightning, explosion, earthquake

The excess shown in the schedule in respect of each claim caused by earthquake.
 

  2.  Windstorm or flood.
 
  • 

The excess shown in the schedule in respect of each claim.

      •  Damage to awnings.
 
  3.  Water escaping from water tanks, apparatus or pipes. Water or oil escaping from a fixed heating or cooling installation.
 
  •  Damage to tanks, apparatus, pipes or installations themselves.
 
  4.  Riot, civil commotion, strike or labour disturbance.
 
   

  5.  Malicious persons or vandals.
 
  • 

Damage caused by the insured.

      •  Damage occurring while the home has been left unoccupied for more than 42 consecutive days.
 
  6.  Theft or attempted theft.
 
  • 

Damage caused by the insured, resident domestic employees or tenants.

      •  Damage occurring while the home has been left unoccupied for more than 42 consecutive days.
 
  7. 

Falling trees or branches.
 

  • 

Damage occurring during tree felling or trimming operations.
 

  8.  Falling television or radio aerials, aerial fittings or masts.
 
     
  9.  Collision involving aircraft or aerial devices or anything dropped from them and impact by vehicles or animals.
 
  • 

Damage caused by domestic pets.

      •  Damage caused by vehicles owned by or being used by or on behalf of the insured.
 

Door Lock Replacement

Cover
In the event of:

Loss or damage by any process of repair or restoration.

the locks of the external doors of the home, we will pay for replacement of the lock mechanism or at our option, we will change the locks, up to a limit of $500 any one period of insurance.

The cost of repairing mechanical breakdown.

Important Messages : Buildings

  1. Please inform us as soon as possible of any changes which take place during the year which could affect any of the cover provided by this policy; for example any changes in use of the property or anything which may increase its value, or the chances of a loss occurring (see General Condition 2).
  2. Certain covers are excluded if your home has been left unoccupied for more than 42 consecutive days but we may be able to continue cover if you inform us in advance.

Accidental Damage to Underground Services

Cover
Drains, pipes and underground cables providing services to or from the home are insured against accidental damage for which the insured is legally responsible.

Accidental Damage to Fixed Glass and Sanitary Fixtures

Cover
Glass and sanitary fixtures (toilets, baths, sinks and the like) fixed to and forming part of the home are insured against accidental breakage.

Loss of Rent and Cost of Alternative Accommodation

Cover
If the home is made uninhabitable as a result of damage by a cause which is covered by this section of the policy we will pay the:

  • rent you would have received but have lost
  • reasonable additional costs of comparable accommodation incurred by the insured during the period necessary to restore the home to habitable condition.

The maximum sum we will pay under this extension is 15% of the buildings’ sum insured at the time the loss or damage occurred.

Sale of the Home

Cover
If you have entered into a contract to sell your interest in the home and, between exchange of contracts and completion of the sale, the home is damaged by a cause which is covered by this section of the policy, the purchaser shall be entitled to benefit from this insurance in respect of such loss or damage when the sale is completed provided the home is not otherwise insured by or on his or her behalf.

Important Messages : Buildings
  1. You should maintain your property in a good state of repair. The policy is not a maintenance contract and does not cover gradual deterioration.
  2. Please inform us if any part of your home is used in connection with any business, or if it will undergo structural alteration or structural repair.
  3. The cover for Accidental Damage to Underground Services described above applies to your legal liability to reimburse others (such as BELCO or TELCO) for the cost of repairing damage which you have caused. Wider cover in respect of accidental damage is available under Optional Extension A1.
     

Building Excess

The Standard web policy excess for windstorm and earthquake is $1,000 each and every loss.

Building Survey Service

As a service to you, we offer a building survey at no cost. Policyholders have found this service very useful as it assists them in determining an estimated insurance value for their home. The survey involves a visit to the property to take the external measurements of the house. (There is no reason for the representative to go into the house) Once the measuring is complete, we calculate the estimated rebuilding cost of the house which should be used as a guideline for the insured value.

This estimated rebuilding value is calculated based upon information we collect from the various architectural surveying and construction companies. As a result, the values we use are our best estimates of rebuilding costs. BF&M representatives are not professional valuers so our suggestions should be used for guidance only. If you require a professional valuation service we recommend that you contact them direct.

Optional Extensions to "Section A: Buildings"
(Operative in each case only if stated in the schedule)

A1. Accidental Damage

Insurance is provided against accidental damage to the buildings.
  

  • 

Damage while the home or any part of it is lent or let.

    • 

Damage by wear and tear, atmospheric or climatic conditions, vermin, insects, fungus, wet or dry rot or gradually operating cause.

    •  Damage to external television or radio receiving equipment or to docks, piers and jetties.
    • 

Faulty workmanship, defective design, the use of defective materials or damage caused thereby.

    • 

Movement, settlement or shrinkage in any part of the buildings or damage caused thereby.

    • 

Damage caused by land movement.

    • 

Demolition of or structural alteration or structural repair to the buildings or damage caused thereby.
 

A2. Subsidence

Cover
Insurance is provided against damage to the buildings caused by:

subsidence and/or heave of site on which the buildings stand or of land belonging to the buildings or
 

  • 

The first $1,000 of each claim.

  ii. 

landslip.

Damage to patios, terraces, footpaths, swimming pools, tennis courts, drives, walls, fences and gates unless the home is damaged by the same cause and at the same time.

    •  Damage to solid floor slabs or loss or damage belonging to the buildings or resulting from the movement of solid floor slabs unless the foundations beneath the external walls of the home are damaged by the same cause and at the same time.
    • 

Damage resulting from coastal erosion.

    • 

Damage to docks, piers and jetties.

    • 

Demolition of or structural alteration or structural repair to the buildings or damage caused thereby.

    • 

Faulty workmanship or the use of defective materials or damage caused thereby.
 

A3. Satellite Dishes

Exclusions
  Insurance is provided against loss of or damage to external television or radio receiving equipment by any of the causes numbered 1 - 9, damage to Buildings.
 
 
 
  • 

Loss of or damage to satellite dishes which have not been installed and maintained in accordance with the manufacturer’s specifications.

    • 

The first 10% of the sum insured by this extension or the first $250 (whichever is the greater) in respect of each claim.

    • 

Loss or damage which is specifically excluded in respect of any of the causes numbered 1 - 9, damage to Buildings.
 

Claims Settlement Basis : Buildings

We will pay the cost of work carried out in repairing or replacing the damaged parts of the buildings, including fees and associated costs.

If at the time of any loss or damage the sum insured on the buildings is less than the full rebuilding cost then you shall be considered as being your own insurer for the difference and shall bear a proportional share of such loss accordingly. The full rebuilding cost shall mean the full cost of rebuilding all the buildings in the same form, size, style and condition as when new including fees and associated costs.

If the buildings have not been maintained in a good state of repair then we will pay the cost of repair or replacement less a deduction for wear and tear.

If the repair or replacement is not carried out we will pay the reasonable estimated cost of repair but not exceeding what it would have cost to repair the damage to the buildings if the repair work had been carried out without delay.

We will not pay for the cost of replacing or repairing any undamaged part of the buildings which is part of a set or part of a common design or function when the damage is restricted to a clearly identifiable area or to a specific part.

The maximum amount payable in respect of any one claim is the sum insured (less any excess shown in the policy or the schedule).

Automatic Reinstatement of Sum Insured

The sum insured under "Section A: Buildings" will not be reduced following settlement of any claim provided the damaged parts of the buildings are repaired or replaced without delay.

Building Sum Insured Calculator

We have designed this Sum Insured Calculator to assist you in determining a realistic sum insured for your home. We are not professional property valuers and we rely on current information from a variety of sources to obtain an average range for reconstruction costs. These sources include construction companies, architectural companies and property appraisers. We are currently using Standard Bermuda construction costs between $160 and $180 per square foot. Should you require a professional property valuation, we suggest that you contact a recognised and qualified property valuer.

To find out the approximate rebuilding cost for your home, simply select the square footage for each storey of your home and leave the rest to the calculator.

Important Messages : Buildings

Unless your sum insured represents the full rebuilding cost (as defined above) of your home including its outbuildings or swimming pool, you may not receive payment of your claim in full. If you make improvements or additions to your home, please remember to increase your sum insured. Also, building costs tend to increase over a period of time so your sum insured should be reviewed on a regular basis.

 
Section B: Contents

Definition
Furniture, household goods and personal effects, including money up to a limit of $250, belonging to or the responsibility of the insured or any domestic employees residing with you.

Loss of or Damage to the Contents of the Home

When in the home, the contents, are insured against loss or damage by the following causes:


 

  • 

Any amount exceeding 5% of the total sum insured on contents in respect of any one item of valuable property unless separately specified and any amount exceeding one-third of the total sum insured on contents in respect of all valuable property.

    •  Mechanically propelled or assisted vehicles (other than gardening machinery and pedestrian controlled vehicles), trailers, aircraft, water-craft or parts or accessories for any of them.
    •  Securities and documents of any kind.
    •  Landlord’s fixtures and fittings.
    •  Contents more specifically insured.
  1.  Fire, lightning, explosion, earthquake.   •  The excess shown in the schedule in respect of each claim caused by earthquake.
  2.  Windstorm or flood.
 
  • 

The excess shown in the schedule in respect of each claim.

  3.  Water escaping from water tanks, apparatus or pipes. Water or oil escaping from a fixed heating or cooling installation.

Important Messages: Contents

  1. Please note that unless separately specified in the schedule or any endorsement, the most that will be paid for any one item of valuable property (defined on Page 5) is 5% of the total sum insured on contents. The most that will be paid on any one claim for all such property lost or damaged by a single cause is one third of the total sum insured on contents. You should inform us if either of the above limits are insufficient for your requirements.
  2. Certain covers are excluded if your home has been left unoccupied for more that 42 consecutive days but we may be able to continue cover if you inform us in advance.

Contamination of Fresh Water

Cover
The cost of emptying the underground fresh water tank and replacing the fresh water following contamination by salt accompanying Windstorm or flood, up to a limit of $500.

Contents in the Open

Cover
 
  When in the open within the boundaries of the land belonging to the home, the contents are insured, up to a limit of $250, against loss or damage by any of the causes numbered 1-9, under Contents cover.

Money.

Loss or damage which is otherwise excluded in the section headed ‘Loss of or Damage to the Contents of the home’.

Temporary Removal of Contents

When temporarily removed from the home, the contents are insured against loss or damage by any of the causes numbered 1 - 9, under Contents cover.

Students Abroad

Cover
 
Personal effects of the insured, who is a full time overseas student, are insured while overseas up to $1,000 in total, against loss or damage by any of the causes numbered 1-9, under Contents cover. The maximum we will pay for any one item of personal effects is $150.
 
Exclusions
 
    • 

Loss or damage by theft unless there is forcible and violent entry into or exit from a building.
 

    • 

Loss or damage by Windstorm unless the personal effects are in a building.

    •  Valuable property.
 

Accidental Breakage of Glass in Furniture

Cover
Mirrors (other than hand mirrors), plate glass tops to furniture and fixed glass in furniture are insured against accidental breakage.

Loss of Rent and Cost of Alternative Accommodation

Cover
If the home is made uninhabitable as a result of damage by a cause which is covered by this section of the policy, we will pay the:

  • rent you would have received but have lost
  • reasonable additional costs of comparable accommodation incurred by the insured during the period necessary to restore the home to habitable condition.

The maximum sum we will pay under this extension is 15% of the contents sum insured applicable at the time the loss or damage occurred.

Food in Freezer

Cover
 
Food contained in a deep freeze or the freezer section of a refrigerator within the home is insured, up to a limit of $500, against loss or damage caused by a change in temperature or contamination by refrigerant. The deep freeze or refrigerator must not be more than 15 years old.
 
Exclusions
 
    • 

Loss or damage resulting from the deliberate act of any power supply authority or the withholding or restricting of power by such authority.
 

    • 

Loss or damage resulting from the deliberate or accidental disconnection of the power supply within the home by the insured.

    •  Change in temperature as a result of a power failure lasting less than 24 hours.

The Contents Overseas cover and Students Abroad cover are limited. We can provide more extensive cover for travelling family members and for students studying abroad, either on an annual or per trip basis. This can be arranged by a simple phone call or fax.

Credit Cards

Cover
 
Exclusions
 
  Insurance is provided against:
 
 
•  Loss resulting from the unauthorised use of credit cards where the insured has not complied with all the terms and conditions under which the card has been issued.
•  Loss due to confiscation, to depreciation in value or to errors or omissions in receipts, payments or accountancy.
•  Losses not reported to the Police or not reported to and claimed from the issuing authority.
  i.  financial loss resulting from the unauthorised use, by persons other than the insured, of a credit card
 
 
  ii. 

the cost of replacing a credit card which has been stolen or accidentally lost anywhere in the world.
 

 
  The maximum sum we will pay for all claims during any one period of insurance is $1,000.
 
 

Fatal Accident

Cover
If you or your spouse suffer an injury as a result of a fire in your home or caused by thieves at the home and the injury proves to be fatal within three calendar months, we will pay your personal representatives the sum of $5,000.

Domestic Pets

Cover
 
In the event of the death of a domestic dog or cat as a result of any cause insured by this policy, we will pay the cost of replacing the animal with another of the same breed, sex, pedigree up to a maximum of $1,000 any one claim and $2,000 any one period of insurance.
 
Exclusions
 
Domestic dog or cat not in the home at the time of the loss.

Door Lock Replacement

Optional Extensions to "Section B: Contents"

B1. Accidental Damage to TV, Audio,Video and Computer Equipment

  Insurance is provided against accidental damage to televisions, audio, video and computer equipment whilst in the home   • 

Damage to computer equipment by electrical power surges (other than surges caused by lightning) unless the equipment is fitted with an electrical surge protector.
 

    • 

Damage by wear and tear, depreciation, gradually operating cause, process of cleaning, repair or restoration, mechanical or electrical breakdown.

    •  Loss or damage caused by tenants.
 

B2. Subsidence

Exclusions
  Insurance is provided against loss of or damage to the contents caused by:
   
i.  subsidence and/or heave of the site on which the home stands or of land belonging to the home or
ii. 

landslip.

 
•  Loss or damage resulting from movement of solid floor slabs unless the foundations beneath the external walls of the home are damaged by the same cause at the same time.

Loss or damage resulting from:

•  coastal erosion
•  demolition of or structural alteration or tructural repair to the home
•  faulty workmanship or the use of defective materials.

B3. Satellite Dishes

  Insurance is provided against loss of or damage to external television or radio receiving equipment by any of the causes numbered 1 - 9 listed under Contents cover.

Claims Settlement Basis : Contents

New for Old Cover

We will pay the cost of replacement as new (or at our option replace as new) except for:

    1. household linen and clothing where a deduction for wear and tear will be made
    2. items that can be economically repaired (including household linen and clothing) where the cost of repair will be paid.

Household linen shall include towels, tea towels, bed and table linen made of any material.

If at the time of any loss or damage the sum insured on contents is less than the full replacement cost, then you shall be considered as being your own insurer for the difference and shall bear a proportional share of such loss accordingly. The full replacement cost shall mean the cost of replacing all of the contents as new less a deduction for wear and tear on items of household linen and clothing.

The maximum amount payable in respect of any one claim is the sum insured subject to any excess or specific limit stated in the policy or schedule.

We will not pay the cost of replacing or repairing any undamaged part of the contents which forms part of a suite or set or part of a common design or function when the damage is restricted to a clearly definable area or to a specific part or item.

Food in Freezer

We will pay the cost of replacing the lost or damaged food. The maximum amount payable is $500.

Credit Cards

We will pay the amount for which the insured is responsible in respect of loss resulting from the unauthorised use of credit cards subject to a limit of $1,000 for all claims during any one period of insurance. The loss of the credit card must be reported to the Police, and reported to and claimed from the issuing authority. We will pay for any amount that the issuing authority does not cover subject to the policy limits.

Contents Excess

The standard policy excess for windstorm and/or earthquake is $500 each and every loss.

Important Messages : Contents

Unless your sum insured represents the full replacement cost of your contents (less a deduction for wear and tear on clothing and household linen) you may not receive settlement of your claim in full. The items belonging to or the legal responsibility of the insured which are specified in the "All Risks" section of the schedule (including any amount stated in respect of unspecified articles) are insured against accidental loss or damage within the territorial limits specified in the schedule.

The first $50 of each claim for unspecified articles.

In respect of any one unspecified article, any amount exceeding 15% of the sum insured on all unspecified articles.

    •  Motor vehicles, pedal cycles, aircraft, watercraft or parts or accessories for any of them.

Pets and livestock.

    • 

Money or credit cards.

    • 

Unless specified in the schedule, household goods, computers, musical instruments, external television and radio receiving equipment, contact lenses, securities, documents of any kind, china, glass, earthenware and other items of a brittle nature.

Loss by deception unless only entry to the home is gained by deception.

    •  Loss or damage caused by wear and tear, depreciation, insects, vermin, atmospheric or climatic conditions, gradually operating causes, process of cleaning, dying, repair, alteration, restoration, mechanical or electrical breakdown, delay, confiscation or detention by order of any government, public or police authority.

Items used primarily for business or professional purposes.
 

Claims Settlement Basis : All Risks : Personal Possessions

We will pay the cost of replacement as new (or at our option will replace as new) except for:

  1. clothing where a deduction for wear and tear will be made
  2. items that can be economically repaired (including clothing) where the cost of repair will be paid
  3. loss or damage caused by wear and tear, depreciation, atmospheric or climatic conditions, gradually operating cause, repair or mechanical or electrical breakdown.

The maximum amount payable in respect of any one claim is the sum insured (less any excess shown in the policy or the schedule) subject to any specific limit stated in the policy.

"All Risks" insurance does not mean that all losses are covered. Please read the list of exclusions carefully as certain types of property and certain causes of loss are not covered.

 
Section D: Liabilities

1. Owner’s Liability
(Operative only if "Section A: Buildings" is insured by this policy)

  We will indemnify you against all sums which you shall become legally liable to pay for damages and/or claimants’ costs and expenses in respect of accidental bodily injury (including death, disease or illness) or accidental damage to material property occurring during any period of insurance incurred solely as owner (not as occupier) of the home and its land.    •

  We will indemnify you against all sums which the insured shall become legally liable to pay for damages and/or claimants’ costs and expenses in respect of accidental bodily injury (including death, disease or illness) or accidental damage to material property occurring during any period of insurance incurred:
 
a)  solely as occupier (not as owner) of the home and its land
 
b)  solely in a personal capacity (not as owner or occupier of any buildings or land)
 
c) 

as an employer of a domestic servant or gardener where liability arises out of and in the course of the employment, by the insured, of such servant or gardener, at the home or its land (including liability under the Workmen’s Compensation Acts 1965 and 1970 and any subsequent amendments).
 

 
•  Damage to property belonging to or held in trust by or in the custody or control of the insured.
•  Injury or damage arising out of the employment, profession or business of the insured.

Injury (except to an employee) or damage arising out of the ownership, possession or use by or on behalf of the insured of mechanically propelled vehicles (other than gardening machinery and pedestrian controlled vehicles used in or about the home and its land), aircraft, water-craft (other than hand propelled boats), animals (other than domestic cats or dogs and horses used for private hacking).

•  Injury to the insured.
•  Liability resulting directly or indirectly from the transmission of any communicable disease by the insured.
•  Liability arising out of the use of any dock, pier or jetty.

Important Messages : Liability Insurance

This section covers your liability to other persons for accidental personal injury or damage to their property. It covers, where applicable, your liability as owner of the home, occupier of the home, your liability in a personal capacity incurred anywhere in Bermuda and liability to domestic employees. Cover is subject to the Bermuda Jurisdiction Clause. It does not cover awards made in the first instance by a court outside of Bermuda.

3. Tenant’s Liability
(Operative only if "Section B: Contents" is insured by this policy)

  We will indemnify the insured against legal liability arising from the tenancy of the home for damage to the home by any of the causes numbered 1 - 9, under the Building Cover.

Any loss or damage specifically excluded under "Section A: Buildings" of the policy.
 

Limits of Indemnity applicable to "Section D"

The limits of indemnity for all damages and claimants’ costs resulting from one original cause are as follows:

  1. Owner’s Liability: $500,000
  2. Occupier’s, Personal and Employer’s Liabilities: $500,000 (combined limit)
  3. Tenant’s Liability: $100,000

In addition to the above, we will pay defence costs and expenses incurred with our written consent.

Indemnity to persons other than the Insured

This section includes indemnity after the insured’s death to legal personal representatives in respect of liability incurred by the insured and covered by the policy provided that the legal personal representatives observe the terms of the policy as far as they can apply.

Jurisdiction Clause applicable to "Section D"

We shall not be liable in respect of any judgement delivered by or obtained from a court in any country outside Bermuda other than a judgement delivered by the Privy Council of the House of Lords in respect of an appeal from a court within Bermuda.

Furthermore, we shall not be liable in respect of any judgement or order obtained in Bermuda for the enforcement of a judgement obtained in any other country.

Optional Extension to "Section D"

D1. Dock Liability

  • the insured’s personal sports equipment and sports apparel up to $500
  • personal effects of the insured while these items are in a locked room or a locked sports locker up to $250

insured Sports - Scuba Diving, Athletics, Fishing, Golf, Swimming, Cricket, Horse Riding, Cycling, Tennis.

  • 

Breakage of any type of bat, stick or racquet strings unless the handle or frame is broken at the same time.

    • 

Fishing for profit.

    •  Valuable property, cameras, radios, money, animals, vehicles, water-craft.
    •  Water damage unless there is more general external accidental damage.
    • 

The first $50 of each claim.

    • 

Loss or damage whilst being used for racing.

    • 

Theft of unattended cycles unless in a locked building or securely locked to a substantial fixed object.

    •  Damage to tyres by application of brakes or by road punctures, cuts or bruises.
 

Personal Accident

If the insured suffers an injury whilst participating in an insured sport and the resultant injury causes the Death, Permanent Total Disablement, Loss of Limbs or Loss of Sight within twelve calendar months, we will pay the insured or their representatives the sum of $5,000.

We will pay for only one of the noted benefits in respect of the same accident.

  • 

Suicide or any attempted suicide.

    • 

Pre-existing physical conditions of the insured.

    •  Any insured older than 70 at the time of the loss.
    • 

Any injury or death attributed to Decompression Sickness, Caisson’s Disease (Bends), cave diving or diving at depths greater than 30 metres (100 feet).

    • 

Accidents arising out of the insured’s trade or fishing for profit.
 

Geographical Limits for "Section-E: Sports"

The Sports cover provided is subject to the following Geographical Limits:

  • Bermuda and its territorial waters and the recognized fishing banks within 30 miles of Bermuda.
  • The United Kingdom, Canada, The United States of America during temporary visits.
  • In respect of the sports equipment, and sports apparel, transit by land, sea or air to or from the countries mentioned above.

Claims Settlement Basis

Exclusions Which Apply To The Whole Policy

This policy does not insure:

  1. Radioactive Contamination
    Any expense, consequential loss, legal liability or any loss or damage to property directly or indirectly caused by or contributed to by:
    1. ionising radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel
    2. the radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or nuclear component thereof.
  1. War Risks
    Any consequences of war, invasion, act of foreign enemy, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection or military or usurped power.
     
  2. Sonic Booms
    Loss or damage by pressure waves caused by aircraft or other aerial devices travelling at sonic or supersonic speeds.
     
  3. Depreciation
    Loss or damage caused by wear and tear, depreciation, atmospheric or climatic conditions, gradually operating cause, repair or mechanical or electrical breakdown.

Important Messages

The above risks are generally uninsurable and exclusions of this type are common to almost all property insurances.

 
General Conditions
  1. Care and Maintenance of the Property Insured
    The insured shall take reasonable care to prevent loss of or damage to the property insured and shall maintain such property in sound condition.

  2.  
  3. Material Changes in Risk
    You must notify us as soon as possible in the event of any changes in circumstances which may increase any of the risks insured.
     
  4. Cancellation of the Policy
    You may cancel the policy at any time by forwarding written notice to us. If no claims have been made during the period of insurance, a refund of premium may be made in respect of the unexpired portion of the period of insurance but subject to our entitlement to retain a suitable minimum premium.
  5. We may cancel the policy by forwarding seven days’ written notice to you at your last known address, in which case, you shall be entitled to a pro rata refund of premium for the unexpired portion of the period of insurance.

  6. Transfer of Interest
    Interest in this policy may not be transferred without our written consent. Unless expressly provided by endorsement, this policy does not grant any rights against us to persons other than the insured.

These conditions apply to the whole policy. Some of them impose duties with which you must comply. Breach of these duties may invalidate your claim - please read them carefully.

 
Claims Conditions
  1. Notification of Claims
    In the event of any occurrence which may give rise to a claim under the policy, you must take the following action:
    1. notify us as soon as possible or in the case of an occurrence which may give rise to a claim under Section D: Liabilities of the policy, notify us immediately and send to us any letter, writ, summons or claim received in connection with such an occurrence immediately it is received. The insured must not admit, reject, negotiate or settle any claim without our prior consent
    2. notify the police immediately following any incident of theft, attempted theft, malicious damage or riot damage
    3. notify the credit card issuing authority immediately if a credit card is lost or stolen
    4. at your own expense, supply us with written details of the claim including any information which we may reasonably require.
  1. The Company’s Rights
    1. We may take over and conduct in the name of the insured the defence or settlement of any claim.
    2. We may take legal action in the name of the insured at our own expense and for our own benefit to recover compensation from others for payments which we have made under the terms of the policy.
    3. We may enter any building where loss or damage has occurred and deal with any salvage in a reasonable manner. However, the insured may not abandon any property to us without our consent.
  1. Other Insurances
    If at the time of any claim under this policy there is any other insurance covering the same loss, damage or liability or any part of it, we will pay only our rateable proportion of the claim.
     
  2. Disagreement over amount of claim
    Where we have accepted a claim but there is disagreement over the amount to be paid, the matter will be referred to an arbitrator appointed in accordance with current statutory provisions. If this happens, legal proceedings cannot be commenced until an award has been made by the arbitrator.

Making a Claim

The following notes are provided to help guide you in making a claim.
If you think that you may have a valid claim under the policy, you should take the following action:

  1. Read the relevant section of your policy to see if you think the loss is covered. Each section of the policy contains details of what is covered and what is excluded. If you are in any doubt, ask us; we are here to help you.
     
  2. Refer to the Policy’s Claims Conditions section and read Condition 1. Notification of Claims. Note in particular the requirement to inform the police and the credit card issuing authority immediately in certain circumstances and the requirements regarding claims under Section D: Liabilities. In no circumstances should you admit, reject, negotiate or settle any claim made against you by persons holding you responsible for damage to their property or bodily injury which they have suffered.
     
  3. Contact us as soon as possible. Immediate advice is essential if the damage is serious. We may require you to complete a claim form.
     
  4. Obtain estimates as soon as possible for repairing any damage. Any temporary repairs necessary to make your property weatherproof (if, for example, the roof has been damaged) can be undertaken immediately. However, we should be given an opportunity to inspect the damage before permanent repairs are carried out.

We will inform you if the damage needs to be inspected or if additional details are required before the claim can be settled.
